I've successfully tried, at least, two trials per year for 30 years in practice.
I fully understand the technical and emotional aspects of such cases. Cross examination of
alleged victims and, in many cases, children, using experts such as Child Interview
experts, DNA technicians, and the like. These are highly inflammatory and difficult for one,
so accused, to deal with.

Domestic Violence: Between two persons, married or living together
Although this is usually charged in the police document or Indictment as a separate charge.
It is really a category which enhances the punishment and ties the hands of the DA
in order to have the case dropped. Our experience here is enhanced by our Family Law practice.

These cases have become extremely specialized.
The most common charges with Domestic Violence are:
Assault: the unlawful touching of a person creating pain and/or injury
Harassment: Annoying, alarming or otherwise unauthorizedly pushing or
shoving.
Disturbing the Peace: a form of harassment but easier for the DA to prove
Telephone Interference: preventing one from calling 911
Wiretapping: listening into other's conversations or recording one, in some cases.
Child Abuse: spanking or punishing, leaving bruises.
False Imprisonment: not allowing a spouse or lover to leave the premises
Kidnaping: such as parental kidnaping
Embezzlement: secretly stealing
Theft: such as Shoplifting
Employee Theft:
All three categories comprise some sort of a taking of money or property,
without physical force or a weapon used.
We have tried and negotiated restitution plea bargains for hundreds of such cases.
A person may find himself in a position where personal finances or need for emergency
money have encouraged him/her to "help themselves" with the future intention of returning the money.
Cases involving businesses, that have had such money or property taken,
are handled by the DA's offices in a much harsher fashion than a straight stealing situation.
The thinking is that there is a betrayal of someone in a position of trust.
We have handled cases involving $1,400,000 and $300,000 very recently.
In each case we were able to offer restitution with either probationary sentencing,
or in the case of the $1,400,000, a sentence to a half-way house, as opposed to the penitentiary.
However, in certain other cases, we have tried these matters, to a successful acquittal,
based on others in a position to take the funds throwing blame upon our clients.
This is not that unusual occurrence.
Automobile Theft: taking or using someone's car without permission.
Rental Car Company Theft: keeping the vehicle past the contract terms.
Grand Larceny Auto: taking an automobile worth over $1500.
We have represented numerous cases, through plea bargains and trials with
excellent results.
Homicide: Sometimes called Murder.
Murder: The taking of a life.
Manslaughter: The taking of life without malice aforethought (planning): heat of passion, and self-defense.
Criminally Negligent Homicide: usually automobile related
We have represented people charged with such crimes, especially husbands-wives, and
people in a loving relationship. So many times, it is critical to be able to prove a case
where such emotional or physical circumstances removed responsibility from the charged party.
Domestic violence, alcohol, drugs, heat of passion and the like. DNA and other evidence
such as fingerprints, hair samples etc.
We have good alternate professionals that we use on a regular basis.
Narcotics: better know as drug cases
Drugs: possession, possession with intent to sell, undercover
sales, manufacturing and
producing drugs. LSD, Ecstasy, Cocaine, Crack, Heroin, Speed,
Methamphetamine, etc. are cases where we have expertise.
Joe was Deputy Chief of Narcotics as a DA and knows these areas with extraordinarily wide experience.
Weapons: possessing, using, or displaying guns and the like are areas we have handled quite a bit.
The constitution allows for self protection and the possession of weapons.
Sometimes, store owners or those who carry large sums find a special need to protect themselves.
We have tried and dealt suchcases.
Burglary: used to be called Breaking and Entering
Trespass: going on property without permission
So many times, we've had to prove that there was an exigent circumstance which justified
the alleged trespass or burglary.

Robbery: forcibly taking property or money with a weapon or violence
